The November elections will play a significant role in the final fate of the federal level Marketplace Fairness Act. The Republican majority in the House is not satisfied with the bill in its current form, and attempts at passing it during the current lame duck session have been unsuccessful so far. The Senate has tried to tie the bill to the Internet Access Tax measure, but the House has already passed a permanent extension on taxing internet access. Meanwhile, the ecommerce giants continue to battle over its passage, with Amazon wanting passage while EBay fights it. In addition, some states may now pursue Alibaba in a manner similar to the individual deals with Amazon, as the company has been identified as a large source of potential tax revenue. Illinois has amended their click through nexus legislation following a state Supreme Court ruling in October.
