Paid for Content and Native Advertising Guidelines

E-commerceEarlier this year, the Internet Advertising Bureau (IAB) issued new guidelines to the online marketing industry on native or content based advertising. One of the key recommendations was that online marketers and website owners need to provide a way for online users to distinguish between paid for native ads and general website content.

Website owners produce a wide variety of online content that is not only aimed at engaging or informing their users, but also generates consumer interest for advertisers. Content that is based on a commercial relationship existing between a website owner and an e-commerce advertiser is not always obvious.

Tax Update
Nebraska Gov. Pete Ricketts signed LB200, a bill directing the state’s Department of Revenue to direct funds from internet tax revenues to the property tax fund should a national bill ever pass. Tennessee’s Click-Through Nexus tax becomes effective July 1, 2015. Click through nexus legislation in Nevada takes effect on October 1, 2015. Amazon has begun collecting taxes in Ohio since the company now has a physical presence (warehouse); Ohio legislators nevertheless introduced Click-Through Nexus Legislation as well. Washington has also introduced Click-Through Nexus legislation. The House passed the Permanent Internet Tax Freedom Act banning state and local taxes on internet taxes. Rep. Jason Chaffetz introduced the Remote Transactions Parity Act of 2015 which calculates sales tax based on the seller’s location rather than the buyer’s location; response was mixed both within the House and externally as well.
